1. Acceptance of Terms
By submitting a quote request, placing an order, or otherwise engaging with Roc 3D Printing ("Company," "we," "us"), you ("Client," "you") agree to be bound by these Terms of Service. If you do not agree, do not submit a request or place an order.
2. Quotes & Pricing
All quotes are estimates based on the information provided at the time of submission. Final pricing is confirmed in a written invoice prior to production. Quotes are valid for 14 calendar days from the date issued. Rush orders (ASAP timeline) are subject to a rush fee of up to 50% of the base order price, communicated at time of quote. We reserve the right to revise pricing if submitted files, specifications, or quantities change materially after the initial quote.
3. Orders & Payment
Production begins only after a written order confirmation and receipt of payment or an agreed deposit (minimum 50% for orders over $200). Payment is due in full prior to shipping or pickup unless otherwise agreed in writing. We accept major credit/debit cards, ACH transfer, and other methods as noted on your invoice. Invoices unpaid after 30 days from the due date are subject to a late fee of 1.5% per month on the outstanding balance.
4. File Submissions & Intellectual Property
By submitting 3D files, designs, or other materials, you represent and warrant that you own or have the legal right to use and reproduce those materials, and that production of the requested parts does not infringe upon any third-party intellectual property rights, patents, trademarks, or copyrights. We will not knowingly reproduce licensed characters, patented designs, or counterfeit goods. You retain ownership of all files and designs you submit. We will not share, sell, or reproduce your files for any third party without your written consent.
5. Design Services
Where we provide CAD modeling or design services, completed designs remain our property until payment is received in full, at which point all rights transfer to the Client. We reserve a royalty-free right to display photos of completed work in our portfolio unless you request confidentiality in writing prior to the start of the project.
6. Turnaround Times
Estimated turnaround times are provided in good faith and are not guaranteed unless expressly stated in a written agreement. We are not liable for delays caused by equipment issues, material availability, carrier delays, or circumstances outside our reasonable control. Rush timelines are best-effort and refunds for missed rush deadlines are handled on a case-by-case basis.
7. Quality, Tolerances & Approvals
FDM 3D printing has inherent layer lines, dimensional tolerances (typically ±0.2–0.5mm unless tighter tolerances are agreed in writing), and material characteristics that the Client acknowledges. We will make reasonable efforts to match stated color preferences; exact color matching is not guaranteed due to filament batch variation. For orders of 10+ units, a print sample/approval step is available upon request. Approval of a sample constitutes acceptance of that quality level for the batch. We are not responsible for design errors in files provided by the Client.
8. Returns, Reprints & Refunds
Due to the custom nature of 3D printing, all sales are final unless there is a verified defect in workmanship attributable to us. Defects must be reported within 5 business days of delivery with photographic evidence. We will reprint or refund at our discretion for confirmed defects. We do not offer refunds for prints that are correct per the submitted file but do not meet unstated expectations, or for dimensional issues within stated tolerances.
9. Shipping & Risk of Loss
Risk of loss transfers to the Client upon handoff to the carrier or at time of local pickup. We are not responsible for damage, loss, or delays caused by carriers. We recommend purchasing shipping insurance for high-value orders; this can be arranged upon request and added to your invoice.
10. Limitation of Liability
To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or related to these Terms or any order shall not exceed the amount paid by you for the specific order giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind, including lost profits, loss of data, or business interruption.
11. Prohibited Uses
You may not use our services to produce weapons, illegal items, items intended to harm individuals, counterfeit goods, or items that infringe on intellectual property rights. We reserve the right to refuse any order at our discretion without explanation. Orders refused for prohibited uses will be refunded in full.
12. Confidentiality & NDAs
We will treat all project files and specifications as confidential and will not share them with third parties without your consent. For projects requiring formal Non-Disclosure Agreements, please request one before submitting files. We are happy to execute a mutual NDA prior to project commencement.
13. SMS Messaging Program
Roc 3D Printing operates a transactional SMS messaging program for customers who explicitly opt in. The program is used solely to send messages related to a specific quote, order, or inquiry you have submitted (e.g., confirmations, status updates, appointment reminders, replies to questions). We do not send marketing or promotional SMS through this program.
Opt-in. You opt in by checking the SMS consent checkbox on the quote form or contact form and providing a valid mobile number. The checkbox is unchecked by default and is not required to submit the form. Consent to SMS is not a condition of any purchase or service.
Message frequency and rates. Message frequency varies based on activity on your project. Message and data rates may apply per your mobile carrier's plan.
Opt-out (STOP) and help (HELP). Reply STOP to any message to opt out at any time; you will receive one final confirmation and no further SMS. Reply HELP for assistance, or contact [email protected] / (585) 620-2688.
Carrier liability. Mobile carriers (including but not limited to AT&T, T-Mobile, Verizon, and their affiliates) are not liable for delayed or undelivered messages. Roc 3D Printing is not responsible for any charges imposed by your mobile carrier.
Age restriction. Our SMS program is intended for individuals 18 years of age or older. By opting in, you represent that you are at least 18 and that the mobile number you provide is your own or that you are authorized to receive messages at that number.
Privacy. Phone numbers and SMS opt-in data are not shared, sold, or rented to any third parties or affiliates for marketing or promotional purposes. See our Privacy Policy and SMS & Messaging Policy for full details.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws provisions. Any dispute not resolved informally shall be submitted to binding arbitration in Monroe County, New York under the rules of the American Arbitration Association. The prevailing party shall be entitled to reasonable attorney's fees and costs.
15. Modifications
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new effective date. Continued use of our services after such posting constitutes your acceptance of the updated Terms.
